Official Rules

THE FOLLOWING SWEEPSTAKES IS INTENDED FOR PLAY IN THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA (“D.C.”) ONLY, AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT EIGHTEEN (18) YEARS OF AGE OR OLDER AND A LEGAL RESIDENT OF AND LOCATED IN THE FORTY-EIGHT CONTIGUOUS UNITED STATES OR D.C. AS OF FEBRUARY 21, 2008.

1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ELIGIBILITY: This Sweepstakes begins 2/21/08 at 12:00:00 a.m. Eastern Standard Time (EST) and ends 9/30/08 at 11:59 p.m. Eastern Daylight Time (EDT) (the “Entry Period”) and is open to residents of the forty-eight (48) contiguous United States and D.C. who are at least eighteen (18) years old as of 2/21/08 and licensed drivers. Employees, officers and representatives of Advance Stores Company, Incorporated (“Sponsor”), BASS, ESPN, Promotion Activators, Inc. and their affiliates, and their immediate families and household members are not eligible to participate. For purposes of these rules, immediate family member means parent, child, legal guardian, sibling, step-parent, step-sibling or grandparent. VOID IN ALASKA, HAWAII; JEFFERSON COUNTY, KENTUCKY; AND WHERE PROHIBITED OR RESTRICTED BY LAW. Incomplete or inaccurate entry forms will be considered ineligible and void. Additional restrictions may apply. In the event that the Sweepstakes is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Sweepstakes, or to disqualify participants residing in the affected geographic areas. In such event, Sponsor shall have no liability to any participants who are disqualified due to such an action.
2. HOW TO ENTER. You may enter online or by mail. Participants must fill out the required fields on the required Sweepstakes entry form to be eligible to win the Sweepstakes.
   
   To enter online, go to http://www.advanceautoparts.com/bass. You will be asked to provide your name, age, address, phone number, and valid e mail address. LIMIT ONE ENTRY PER PERSON/HOUSEHOLD/E-MAIL ADDRESS PER 24 HOUR PERIOD. All online entries must be received during the Entry Period. If an entrant uses multiple e-mail addresses to submit more than one online entry per 24 hour period during the Entry Period, only the first online entry for that 24 hour period will be accepted. Automated entries are prohibited, and any use of such automated devices will cause disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual (and all of his or her Sweepstakes entries) who tampers with the entry process. Sponsor reserves the right to cancel or suspend this Sweepstakes and randomly award the prizes from among all eligible entries received prior to action taken by Sponsor, should fraud, virus, bug or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Sweepstakes. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors failures or delays in computer transmissions or network connections that are human or technical in nature. All online entrants must have a valid e mail address.
   
   To enter by mail, entrants must handprint or type the following information on a 3” x 5” card; your name, age, address, phone number, and valid e mail address (optional) and send in an envelope to: Advance Auto Parts “Rigged Up Truck Sweepstakes”, P.O. Box 8516, Prospect Hts., IL 60070. Only one mail-in entry per outer envelope is allowed. Submitted entries that are mechanically reproduced, forged, altered, or photocopied are ineligible and will be voided. To be eligible for the drawing, mail-in entries must be postmarked by 9/30/08 and received by Sponsor at the mail-in address no later than 10/15/08.
   
   Limit one entry per person/household/e-mail address per 24 hour period (regardless of entry method).
3. SWEEPSTAKES RESTRICTIONS. Sponsor reserves in its sole discretion the right to modify, cancel or suspend this Sweepstakes should infection by computer virus, fraud, technical failures, tampering, unauthorized intervention, bugs, or other causes beyond the reasonable control of Sponsor corrupt the administration, security, fairness, integrity or proper play of the Sweepstakes or for any reason Sponsor deems it necessary. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor will post a notice at http://www.advanceautoparts.com/bass and conduct a random drawing from among all Eligible Entries received as of the date of termination to determine the Grand Prize winner. Sponsor is not responsible for computer system, hardware, software or program malfunction or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the "authorized account holder" and/or user of the e-mail address used to enter the Sweepstakes, provided that person meets all eligibility criteria set forth in the Eligibility section of these Official Rules. "Authorized Holder" shall mean the natural person assigned an e-mail address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Please see the website's privacy policy at http://www.advanceautoparts.com for details of the Sweepstakes policy regarding the personal information collected in connection with this Sweepstakes. Your information will not be shared with any third party. Entries that have been tampered with or altered are void.
4. DRAWING/ODDS. One (1) Grand Prize winner will be drawn at random from all eligible entries internet and internet entries received during the sweepstakes entry period, on or about 10/16/08. All drawings will be conducted by an independent judging organization whose decisions shall be final in all matters relating to the Sweepstakes. Odds of winning prize depend on the total number of eligible entries received during each entry period.
5. GRAND PRIZE: One (1) 2006 Toyota Tundra Pickup Truck, including a V8 4.7 Liter engine, automatic transmission, 4 wheel drive, air conditioning, cruise control, AM/FM stereo, power steering, power door locks, ABS, tilt steering wheel and towing package, as well as nineteen (19) premium accessories from Lund, Herculiner, and Hella, among others. Truck and features may be viewed at http://www.advanceautoparts.com .Truck is pre-driven and will be awarded in “as is” condition with up to 50,000 miles on its odometer. Winner must possess a current, valid, driver’s license and must present such license and proof of insurance, and a copy of a valid social security card in order to take possession of the vehicle. All other costs related to prize acceptance and use are the responsibility of winner, including but not limited to taxes, title, insurance, license, and registration fees. Truck will be trailered and/or driven to the winner’s residence within 30 days after selection and qualification of the winner. Advance Auto Parts exterior promotional markings are removable at winner’s option and expense after truck is delivered. Approximate Retail Value (“ARV”): $23,400.00.
6. WINNER NOTIFICATION/PRIZE RESTRICTIONS. Grand Prize winner will be notified by overnight delivery and will be required to confirm identity and eligibility by signing and returning an Affidavit of Eligibility and a release of liability and publicity within fourteen (14) days of notification (first attempted delivery). If a winner is eighteen (18) years old, but considered a minor in his/her state of residence, the Grand Prize may be awarded on the minor’s behalf to a parent/legal guardian of minor, who must execute and return any required documents as noted previously in these rules. If the potential Grand Prize winner cannot be contacted, is ineligible, or fails to return any of the required documents, the Grand Prize will be forfeited and awarded to an alternate winner selected in a random drawing from the remaining eligible entries. Entries become property of Sponsor and will not be returned. Except at Sponsor's discretion, no cash redemption, substitution, or transfer of a Grand Prize is allowed. In case of unavailability of the Grand Prize, the Sponsor reserves the right to substitute a prize or prize element of equal or greater value. After delivery of the Grand Prize, all costs associated with accepting the prize, including but not limited to federal, state and local taxes, will be the responsibility of the Grand Prize winner. Any and all applicable federal, state and local taxes as well as any expenses which are not expressly described herein are solely the responsibility of the Grand Prize winner. By accepting the Grand Prize, winner grants Sponsor the right and in perpetuity to use his/her name, picture/portrait, likeness, voice, statements submitting descriptive information, and biographical information in whole or in part, as may be adapted, edited, or modified, as solely determined by Sponsor for advertising, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without further compensation or permission, except where prohibited by law. ANY VIOLATION OF THESE OFFICIAL RULES BY THE GRAND PRIZE WINNER (AS DETERMINED BY SPONSOR IN ITS SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMIEDIATELY TERMINATED.
7. GENERAL CONDITIONS. All interpretations and decisions under these Official Rules by Sponsor are final. Sponsor reserves the right at its sole discretion to disqualify any individual it finds: (a) to be tampering with the entry process or the operation of the Sweepstakes or the http://www.advanceautoparts.com/bass website; (b) to be acting in violation of the Official Rules; or (c) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE VIRGINIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSY REGARDING THE SWEEPSTAKES, AND THE LAWS OF THE STATE OF VIRGINIA SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
8. LIMITATION ON LIABILITY/RELEASE. Sponsor is not responsible for incorrect, late, lost, misdirected, illegible, corrupted, delayed, mutilated, stolen, incomplete or postage-due entries or mail; or for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Sweepstakes. AS A CONDITION OF ENTERING, ENTRANTS (OR THEIR PARENT OR LEGAL GUARDIAN IF AN ELIGIBLE MINOR) AGREE (AND AGREE TO CONFIRM IN WRITING): (A) TO RELEASE AND HOLD HARMLESS SPONSOR, ITS PARENT, AFFILIATES, SUBSIDIARIES, RETAILERS, SALES REPRESENTATIVES, DISTRIBUTORS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (“PROMOTION PARTIES”) FROM ANY AND ALL LIABILITY FROM AND AGAINST ANY CLAIMS, DEMANDS, AND CAUSES OF ACTION FOR PERSONAL INJURY AND/OR THEFT, LOSS OR DAMAGES OF ANY KIND INCURRED ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE AWARD, RECEIPT, POSSESSION, AND/OR USE OR MISUSE OF THE GRAND PRIZE; (B) UNDER NO CIRCUMSTANCE WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES; (C) ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; AND (D) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARD SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, EXCLUDING ATTORNEY’S FEES AND COURT COSTS. By accepting prizes, winners agree that Promotion Parties will not be held responsible for any system damage, loss of property, accidents, injuries, or death that may occur in the receipt, awarding, use or possession of the Grand Prize and/or participation in any Grand Prize related activity, including any travel related thereto. Winners acknowledge that Promotion Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on the Grand Prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. By participating in this Sweepstakes, entrants and winners agree to be bound by these rules, the decisions of Sponsor, which are final in all matters relating to this Sweepstakes, and any applicable federal, state or local laws and regulations.
9. GOVERNING LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of these Sweepstakes Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Virginia without regard to conflicts of law principles. All entrants consent to the jurisdiction and venue of the state of Virginia.
10. WINNER'S LIST. To obtain the winner’s name, send a self-addressed stamped envelope to Advance Auto Parts “Rigged Up Truck Sweepstakes” Winner, 1851 Elmdale Avenue, Glenview, IL 60026 by 12/31/08. Winner's name will be sent when winner has been verified and prize has been awarded. VT residents may omit return postage.
